Seattle U.S. District Judge John Cohenour has issued a temporary restraining order against President Donald Trump’s executive order restricting birthright citizenship. The president and the Justice Department have vowed to appeal, CNN and Reuters report.

The judge’s ruling, announced after a brief hearing on January 23, bars Trump’s policies from being implemented nationwide for 14 days while the judge considers whether to issue a long-term preliminary injunction.

“I find it difficult to understand how a member of the bar can say unequivocally that this order is constitutional. It’s mind-boggling,” the judge told a Justice Department lawyer defending Trump’s order.

He noted that he has worked in the court for more than 40 years and cannot recall such an “unconstitutional decree.”

At the same time, Trump said from the Oval Office that he plans to appeal the judge’s decision.

“Of course, we will appeal. They presented it to a certain judge in Seattle, I believe, yes? And there are no surprises with that judge,” the American president said.

The Justice Department said it would “vigorously defend” the executive branch’s actions. A spokesman for the department said it “looks forward” to presenting a full case to the court and the American people.
